As Twitchy reported this weekend, a customer at a taqueria in southwest Houston shot and killed a robber — and then gave patrons back their stolen items and left. Police put out stills of the man and his pickup truck saying they just wanted to speak to him … he hadn’t been charged with anything. News reports fussed that the man had shot the robber in the back after he was done robbing everyone, that the robber was black and the shooter was white, and that the robber wasn’t even carrying a real gun, but rather a plastic pistol.

The New York Post is reporting that the armed diner will face a grand jury over the shooting. The diner’s name has not been released because he hasn’t yet been charged with a crime.

The Post reports:
A Texas grand jury will decide whether to criminally charge a Houston taqueria patron who shot a robber dead last week, police said.
The Houston Police Department announced Monday the 46-year-old customer has turned himself in and is cooperating with the investigation into the deadly shooting. He has not been named because he was not arrested or charged with any crime.

Records indicate that the robbery suspect, Eric Washington, had an extensive criminal history and was out on bond at the time of the fatal shooting.
In 2015, Washington was convicted of aggravated robbery with a deadly weapon and sentenced to 15 years in prison in connection with the fatal shooting of 62-year-old Hamid Waraich two years prior.
Washington was released on parole in 2021 after serving less than half of his sentence, but he was back behind bars in mid-December after being arrested for allegedly shoving and scratching his girlfriend.

Robber was sentenced to 15 years in prison in 2015 for a previous robbery/murder.
Out on parole since 2021 and then got arrested for beating his girlfriend. Not sent back to prison even though he clearly violated his parole.

The argument is that he shot the career criminal too many times — that last shot was unnecessary. But seeing he was just held up at gunpoint, maybe his thoughts were to make sure the robber was put down.
