As Twitchy reported, the State Department is still trying to spin the Hillary Clinton email scandal, this time by explaining that Secretary of State Clinton might have received classified emails on her private server, but she herself never sent any classified materials from her server, so she’s in the clear, right?
Cox Radio reporter Jamie Dupree was among those reporters helping the State Department spread that explanation.
State Dept spox says emails with classified info were sent to Hillary Clinton, but "they weren't sent by her"

.@jamiedupree Anyone w/ a clearance knows they have a legal obligation to immediately report any breach and have system contained.

@jamiedupree It's still a classified data spillage and she would be responsible to report it and get the network cleaned.

@jamiedupree Why is the defense dept sending classified emails to a non govt server?
— jim (@jimsweeney14) August 12, 2015
When you accept TS/SCI clearances, burden is on YOU to handle the information properly. Period. Don't like it? Don't take that big USG job.

@jamiedupree That doesn't FUCKNG matter. Crime happened minute it was sent to home server. See: David Petraeus

Writer and attorney Gabriel Malor takes a look at a similar, hypothetical scenario.
Now an example of a classified spill that I have plucked from thin air. Any resemblance to real persons is purely coincidental, I'm sure.
— Gabriel Malor (@gabrielmalor) August 12, 2015
Example: Person receives a classified briefing, then summarizes the briefing in email sent on unsecured system. That's a spill.
— Gabriel Malor (@gabrielmalor) August 12, 2015
Very important: the info in the email summarizing the classified briefing is *still* classified, though obviously not marked as such.
— Gabriel Malor (@gabrielmalor) August 12, 2015
In my example, we've got multiple security failures.
— Gabriel Malor (@gabrielmalor) August 12, 2015
The person who summarized the briefing erred by not adding derivative marks. Then erred again by sending it over unsecured system.
— Gabriel Malor (@gabrielmalor) August 12, 2015
Then by not self-reporting.
The person who received the email erred by not reporting it upon receipt. Then erred again by storing the email.— Gabriel Malor (@gabrielmalor) August 12, 2015
This example is why there is a duty to report (and self-report) when a spill occurs. Accidents happen. People get sloppy.
— Gabriel Malor (@gabrielmalor) August 12, 2015
This example also demonstrates how classified information can end up unmarked in emails on an unsecure server.
— Gabriel Malor (@gabrielmalor) August 12, 2015
This example also illustrates why classified information is supposed to be in gov't control: so it can be scrubbed when a spill occurs.
— Gabriel Malor (@gabrielmalor) August 12, 2015
Committing any of these errors alone will get you reprimanded. Doing this multiple times across a period of years will get you fired.
— Gabriel Malor (@gabrielmalor) August 12, 2015
Or, hypothetically speaking, elected President of the United States?
Building a system to hide the commission of these errors multiple times across years, would ordinarily result in criminal prosecution.
— Gabriel Malor (@gabrielmalor) August 12, 2015
Anyway, the claim that the classified info was "unmarked" completely dodges the issue. Failure to mark is its own error.
— Gabriel Malor (@gabrielmalor) August 12, 2015
People go to jail for mishandling TS/SCI — and many Americans have died protecting it. Hillary & her staff need to be held accountable.
— John Schindler (@20committee) August 12, 2015
Here’s one law professor and Hillary superfan’s well-reasoned rejoinder to Malor’s hypothetical.

“Blah blah blah.” It does make you think.
